Iraqi laws and international agreements in force at the University of Basrah in the appointment and preservation of the rights of employees

 

- The University of Basrah is one of the public universities in the Iraqi state and is subject to the laws of the Iraqi state, which guarantees all employees working in it the same rights and the same salaries according to efficiency and level of work. Below we will present the treaties, conventions, laws, applicable instructions, international conventions, and United Nations development programs in Iraq adopted at the University of Basrah based on which the policies of the University of Basrah were built for the purpose of employing employees, determining their salaries, preserving their rights and determining their duties without discrimination.

University of Basrah Policy on equality in the wage scale

- Article 14 of the 2005 Iraqi constitution stipulates that “Iraqis are equal in front of the law without discrimination based on gender, race, nationality, colour, religion, sect, belief, opinion, economic or social status.” Moreover, the first paragraph of Article 22 of The Iraqi constitution stipulates that “work is a right for all Iraqis". Furthermore, The Iraqi Labour Law No. 37 of 2015 in Article 53, paragraph 5, stipulates that “men and women who perform a work of an equal value must get the same wages". In all its departments, colleges, and research centres, the factors influencing the calculation of salaries at the University of Basrah are:

1- Customizations: (Years of service, Certificate, Matrimonial, kids and Transportation allocations).

2- Deductions: (Retirement and Income tax).

 

 

 

 

-The University has set policy in equality in the wage scale and non-discrimination between the gender.

- The laws of the Iraqi state guarantee the Iraqi employee a salary that considers the high cost of living, so the salaries of its employees and faculty members at the University of Basrah support the living wage. The following list represents the final budget model for 2021 at the University of Basrah, which shows the mechanism for calculating employees' salaries, which begins with the number (2 - 01 - 01). The sequences from (2 – 01 – 01 – 01) to (2 – 01 – 01 – 10) represent salary details. The sequences from (2 – 01 – 01 – 10 – 01) to (2 – 01 – 01 – 10 – 17) represent additional allowances for the employee, which are (hazard allowances, scientific title allowances, exceptional allowances, engineering allowances, work allowances, university service allowances, geographical location allowances, certificate allowances, professional allowances, support allowances and children's allowances) that cover all living needs.   


University of Basrah Policy on Cooperation with Professional Unions and NGOs 

- After the Universal Declaration of Human Rights was promulgated on 10 December 1948, the world witnessed a revival of the trade union movement, especially after its article 23 states that "Everyone has the right to establish  or organize into trade unions to protect his own benefit", and in Iraq the  Iraqi Constitution of 2005 stipulates in article 22   of it that "the State shall guarantee the right to establish and join trade unions and professional unions, and this shall be regulated by law".  Which gave freedom to the Iraqi citizen to belong to association and collective bargaining. Therefore, the University of Basrah has developed its own policy for dealing with trade unions and professional associations:

Some of the most important unions that University of Basrah deals with are:

  • The Pharmacists Syndicate established by Law No. (112) of 1966.
  • The Syndicate of Physicians established by Law No. (81) of 1984.
  • Teachers' Syndicate established by Law No. (7) of 1989.                
  • The Iraqi Academics Syndicate established by Law No. (61) of 2017.
  • The Nursing Syndicate established by Law No. (8) of 2020.

 


  University of Basrah Policy on forced labor, modern slavery, human trafficking, and child labor 

 - The University of Basrah has developed a policy to prevent corvee or the employment of children under the age of 15 years or dealing with those who employ them. This policy also aims to prevent human trafficking and apply national laws along with international treaties and conventions.

-The policy is based on the Iraqi Constitution and the Labor Law 37 of 2015, so all employees at the University of Basrah  are subject to the above policy. The university also imposes in all its contracts with external suppliers to abide by the Iraqi laws and its own policy in force for the purpose of employing external workers for the purpose of working at the University of Basrah, and therefore the ages of all employees and the external workers are subject to audit before employment.


  University of Basrah Policy in ensuring equal rights for workers when assigning work to a third party 

 

 - The University of Basrah has creat a policy to enable workers to obtain their full rights even if they are not working in the university but for a third party (contractor) and in order to create an appropriate professional and social environment that encourages workers to be productive.

All contracts of the University of Basrah include clauses to ensure the safety of workers and consumers. The video below shows the student club in the College of Business and Economics and contracting with an external supplier (Abu Hassan Restaurant) for the purpose of serving food to students.


  University of Basrah Policy in Protecting those who Report Discrimination from Educational and Employment Deprivation

In compliance with the provisions of the Iraqi constitution, the University of Basrah is working to establish the value of equality in society and protecting those who seek to achieve it, such as people who report excellence, whether in the educational or career field. To ensure that the University continues to implement its policy to achieve equality, it has developed a system for the protection of these persons.

If a case of discrimination is reported in employment, then the procedures of the University of Basrah for processing are as follows:

    1. 1. the affairs department at the University is informed about taking its fundamental measures confidential.
    2. 2. The results of the investigation shall be reported to the secretariat of the Council, for the necessary action to be taken regarding it as soon as possible.
    3. 3. The employee shall be informed of the result of the investigation by an official letter.
    4. 4. the necessary measures shall be taken to stop the discrimination and punish those who caused it.
    5. 5. In the event that the Department of Affairs is not convinced of the situation of discrimination against the employee, the complaint is rejected and in the event that the employee is not convinced he has the right to submit an appeal to the President of the University and when the result of the rejection of the complaint is identical, he can appeal the case before the Iraqi Administrative Court within 30 days of being notified of the rejection of his complaint.
    6. 6. The above procedures apply in all complaints filed by employees whether to appeal against pay determination and/or appraisal reviews.

By discrimination we mean that: an employee of the University of Basrah must not be treated based on race, color, religion (creed), sex, gender expression, age, national origin (descent), disability, marital status, sexual orientation, or military status in any of its activities or operations.

 


    The Career Development Center (CDC)


- The Career Development Center (CDC) at the University of Basrah targets the university students and graduates in order to be trained, qualified and finding an active link between them and the Market needs. It is known how hard to find a good job, so CDC works to build the ability of our students to interpret the theory into practical after graduation. With that aim, the CDC enabled the university to sign several memorandums of understanding with large companies to engage our students into extensive training courses in their majors to be qualified enough. In addition, CDC works with a third party to develop their skills in establishing small businesses and being self-employed. CDC encourages the students to work in the private rather than the public sector or even initiate their own mini project. For more informations click here

Decent Works

 

- The University was assisted to change the daily wages to Government contracts to help them and increase their salary.

- Career Development Centre of the University of Basrah developed work ability of alumni every year. The Faculty of Economic Sciences in University of Basrah was create the Electronic Financial Market to train the student.

 

 

 

- Collaboration with Basrah Gas Company and Basrah Oil company resulted in designation of several alumni of the university.

- The center sponsors ideas and patents and presents them to employers to invest them for the benefit of invention owners

- First career day of the university of Basrah will hold on 29/12/2021.

- The University was employed 1738 persons during 2018-2019 to decrease the jobless.

- Career Development Centre of the University of Basrah developed work ability of alumni every year.
